1. Acceptance of Terms
By accessing or using KSM.store (kisumu.store), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our platform.
KSM.store is an online marketplace connecting buyers and sellers in Kisumu, Kenya. We are not responsible for the products or services offered by individual vendors.
2. User Accounts
- You must provide accurate information when registering
- You are responsible for maintaining the security of your account
- You must be at least 18 years old to create an account
- We reserve the right to suspend accounts that violate these terms
- One account per person — multiple accounts are not permitted
3. Buyer Terms
- All orders are subject to vendor confirmation and product availability
- Delivery fees are calculated based on your Kisumu delivery zone
- Orders above KSh 5,000 qualify for free delivery
- M-Pesa payments are processed securely via Safaricom Daraja API
- Cash on delivery is available across all 24 Kisumu zones
- You must be present at the delivery address to receive your order
- Alcohol products are strictly for buyers aged 18 and above
4. Vendor Terms
- All vendors must complete KYC verification before listing products
- Vendors must provide accurate product descriptions and images
- A platform fee of 2.5% is deducted from each delivered order
- Earnings are paid out within 24 hours of withdrawal request via M-Pesa
- Minimum withdrawal amount is KSh 100
- Vendors must not list counterfeit, expired or illegal products
- KSM.store reserves the right to remove listings that violate our policies
- Vendors are responsible for product quality and accurate descriptions
- Approved vendors must maintain a response rate to customer inquiries
5. Delivery Terms
- KSM.store operates same-day boda boda delivery across Kisumu
- Delivery hours are 7AM to 9PM daily including weekends
- Delivery fees range from KSh 50 (CBD) to KSh 350 (Muhoroni)
- KSM.store is not liable for delays caused by traffic, weather or other factors beyond our control
- Riders are independent contractors — KSM.store facilitates but does not employ riders
- Live GPS tracking is provided for all dispatched orders
6. Payments & Refunds
- All prices on KSM.store are in Kenyan Shillings (KSh)
- M-Pesa payments are processed via Safaricom Daraja and are non-reversible once confirmed
- Refund requests must be submitted within 7 days of delivery
- Refunds are subject to vendor approval and product condition
- KSM.store may mediate disputes between buyers and vendors
- Loyalty points have no cash value and cannot be transferred
7. Referral Programme
- Referral rewards (KSh 50) are credited after the referee's first completed order
- You cannot use your own referral code
- KSM.store reserves the right to modify or terminate the referral programme at any time
- Referral abuse or fraudulent activity will result in account suspension
8. Prohibited Activities
The following are strictly prohibited on KSM.store:
- Listing counterfeit, stolen or illegal products
- Providing false product information or misleading images
- Harassing other users, vendors or KSM.store staff
- Attempting to circumvent platform fees
- Creating fake reviews or ratings
- Using the platform for money laundering or fraud
- Selling alcohol or adult products to minors
9. Intellectual Property
The KSM.store name, logo, #DalaLife brand, website design and all content are the intellectual property of KSM.store. You may not reproduce, distribute or use our branding without written permission.
Vendors retain ownership of their product images and descriptions but grant KSM.store a licence to display them on the platform.
10. Limitation of Liability
KSM.store is a marketplace platform — we connect buyers and sellers but are not the seller of any product. We are not liable for:
- Product quality, authenticity or fitness for purpose
- Delivery delays or failures beyond our reasonable control
- Losses arising from M-Pesa transaction failures
- Indirect or consequential losses of any kind
11. Changes to Terms
KSM.store reserves the right to update these terms at any time. Continued use of the platform after changes constitutes acceptance of the new terms. We will notify users of significant changes via the platform or email.
12. Governing Law
These terms are governed by the laws of Kenya. Any disputes shall be resolved under Kenyan jurisdiction. For disputes, please contact us first at info@kisumu.store — we aim to resolve all issues amicably.
